Terms and Conditions.

These Terms and Conditions govern your access to and use of the Camar website (camar.com), the Camar+ mobile application, and any related software, features, services, connected products, and purchases made through our platforms (collectively, the "Services"). Please read these Terms carefully before using our Services.
By accessing the website, downloading the App, or making a purchase, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
1. COMPANY INFORMATION
The website and App are owned and operated by Camar and its affiliated entities (referred to in these Terms as "Camar", "we", "us", or "our").

2. SCOPE OF SERVICES
Our Services include:
- The Camar website, including product information, content, and links to third-party retailers
- The Camar+ mobile application and its connected device ecosystem
- Direct purchases of accessories and related products made through camar.com
- Account management, support, and product guidance
Many products in the Camar range are fulfilled through third-party retailers. Where a purchase is completed on a third-party platform, that platform's terms and policies apply.
3. ELIGIBILITY AND USER REPRESENTATIONS
By using our Services, you represent and warrant that:
- You are at least the age of majority in your jurisdiction
- You have the legal capacity to enter into these Terms
- You are using our Services for personal, non-commercial purposes unless otherwise authorized
- Your use of our Services complies with all applicable laws and regulations
You are responsible for ensuring that use of our Services is permitted in your jurisdiction.LAYER™ Intelligence is available for adult profiles only. Body composition patterns change significantly during adolescence, so LAYER™ Intelligence is currently optimized for users 18 and over.
4. PURCHASES AND PAYMENTS
Where products or accessories are purchased directly through camar.com, the following applies:
- All prices are displayed in US dollars and are subject to change without notice
- Payment is processed securely through our third-party payment provider
- Orders are subject to availability and confirmation
- We reserve the right to refuse or cancel any order at our discretion
- Applicable taxes and shipping costs will be displayed at checkout
For purchases made through third-party retailers linked from our website, the retailer's own terms, return policies, and payment conditions apply. Camar is not responsible for transactions completed on third-party platforms.
5. RETURNS AND REFUNDS
For purchases made directly through camar.com, please contact us to initiate a return or refund request. Eligibility will be assessed on a case-by-case basis in accordance with applicable consumer protection laws.
For purchases made through third-party retailers, please refer to that retailer's return and refund policy.
6. ACCOUNT REGISTRATION AND SECURITY
Certain features require creation of a user account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain the confidentiality of your login credentials
- Accept responsibility for all activity occurring under your account
You must notify us promptly of any unauthorized access or suspected security breach. Camar is not responsible for losses resulting from unauthorized account use.
We reserve the right to suspend or terminate accounts that violate these Terms or pose security or operational risks.
7. LICENSE AND PERMITTED USE
Camar grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the App for personal use, subject to these Terms.
You may not:
- Copy, modify, reverse engineer, or create derivative works from the App or website
- Sell, lease, sublicense, or commercially exploit our content or Services
- Use our Services to develop competing products or services
- Interfere with or disrupt our website, App, or infrastructure
Any unauthorized use terminates this license immediately.
8. CONNECTED DEVICES AND PRODUCT-SPECIFIC FEATURES
The App may connect to Camar-branded devices and products. Device functionality, supported features, and data generated may vary by product.
The App does not guarantee uninterrupted device connectivity or availability of specific features.
9. DATA AND PRIVACY
Your use of our Services involves the collection and processing of data. All personal data handling is governed by Camar's Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.
LAYER™ Intelligence is powered by OpenAI models. Your data is processed solely to generate your personal insights and is not used to train external AI models.
Your LAYER™ data is retained for as long as your account is active. You may request deletion of your data at any time by contacting us. Deletion requests will be processed within a reasonable timeframe.
10. USER CONDUCT
You agree not to use our Services to:
- Violate any applicable law or regulation
- Infringe intellectual property or privacy rights
- Transmit malware, harmful code, or unauthorized data
- Harass, impersonate, or mislead other users
- Access systems or data without authorization
- Interfere with website or App performance or security
We may investigate and take appropriate action for violations, including suspension or termination.
11. INTELLECTUAL PROPERTY
All intellectual property rights in the website, App, Services, devices, content, trademarks, and software are owned by or licensed to Camar.
Nothing in these Terms grants you ownership rights. You may not use Camar branding without prior written permission.
12. THIRD-PARTY SERVICES AND LINKS
Our website links to third-party retailers and services. Camar does not control and is not responsible for third-party content, pricing, availability, policies, or practices.
Your use of third-party services is at your own risk and subject to their own terms.
13. DISCLAIMERS
Our Services are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Camar disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the website or App will be uninterrupted, error-free, or compatible with all devices.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Camar shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our Services.
Camar's total liability shall not exceed the amount paid by you, if any, for the Services or products in question in the twelve months preceding the claim.
15. INDEMNIFICATION
You agree to indemnify and hold harmless Camar and its affiliates from any claims, damages, losses, or expenses arising from your use of our Services, your violation of these Terms, or your violation of applicable laws or third-party rights.
16. TERMINATION
Camar may suspend or terminate access to our Services at any time, with or without notice, if you violate these Terms or if required for security or operational reasons.
Upon termination, your license ends and access to the App and relevant Services may cease.
17. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of New York, excluding conflict of law principles.
Any disputes shall be resolved through binding arbitration under applicable commercial arbitration rules, unless prohibited by law. All arbitration must be brought in your individual capacity - you waive the right to participate in any class action or representative proceeding.
Any claim arising under these Terms must be brought within one year of the event giving rise to the claim. Claims introduced after this period shall be barred.
18. FORCE MAJEURE
Camar shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including acts of God, governmental action, natural disaster, or other force majeure events. Performance shall resume within a reasonable time following the end of such event.
19. CHANGES TO THESE TERMS
We may update these Terms at any time. We will make reasonable efforts to notify you of significant changes through the website or App. Continued use of our Services after changes are published constitutes acceptance of the revised Terms.
20. MISCELLANEOUS
Entire agreement: These Terms and referenced policies constitute the entire agreement between you and Camar.
Severability: If any provision is found unenforceable, the remainder of these Terms remains in full effect.
Assignment: Camar may assign these Terms without restriction. You may not assign your rights or obligations without our prior written consent.
No waiver: Failure to enforce any provision of these Terms on one occasion does not constitute a waiver of our right to enforce it in the future.
